NTSB releases updates on status of 3 major US investigations

The National Transportation Safety Board (NTSB), the agency responsible for investigating transportation accidents in the United States, released updates on three major investigations on June 14.

The NTSB, well known publicly for its involvement in the investigation of aviation incidents which involve harm or loss of human life, is also an agency that oversees the transportation of refined petroleum and gas products, chemicals and minerals.

The agency determined the cause of a natural gas pipeline explosion that killed six. It also detailed the cause of an accidental release of 204,000 gallons of anhydrous ammonia from a pipeline in an environmentally sensitive area, and released preliminary information involving two commercial aircraft coming within 30-50 feet of each other on a runway.

In the gas explosion disaster, the towing vessel Miss Megan, which was of specifications that did not require inspection by the United States Coast Guard, was being operated in the West Cote Blanche Bay oil field in Louisiana by Central Boat Rentals on behalf of Athena Construction on October 12, 2006. The Miss Megan was pushing barge IBR 234, which was tied along the starboard side of barge Athena 106, en route to a pile-driving location. Athena Construction did not require its crews to pin mooring spuds (vertical steel shafts extending through wells in the bottom of the boat and used for mooring) securely in place on its barges and consequently this had not been done. During the journey, the aft spud on the Athena 106 released from its fully raised position. The spud dropped into the water and struck a submerged, high-pressure natural gas pipeline. The resulting gas released ignited and created a fireball that engulfed the towing vessel and both barges. The master of the towing vessel and four barge workers were killed. The Miss Megan deckhand and one barge worker survived. One barge worker is officially listed as missing.

The NTSB blames Athena Construction for the disaster, citing in the final report that Athena Construction’s manual contained no procedures mandating the use of the safety devices on the spud winch except during electrical work. It was found that if the Athena 106 crew had used the steel pins to secure the retracted spuds during their transit, a pin would have prevented the aft spud from accidentally deploying. Furthermore, the spud would have remained locked in its lifted position regardless of whether the winch brake mechanism, the spud’s supporting cable, or a piece of connecting hardware had failed.

The NTSB also found that contributing to the accident was the failure of Central Boat Rentals to require, and the Miss Megan master to ensure, that the barge spuds were securely pinned before getting under way. The Board noted that investigators found no evidence that the Miss Megan master or deckhand checked whether the spuds had been properly secured before the tow began. While Central Boat Rentals had a health and safety manual and trained its crews, the written procedures did not specifically warn masters about the need to secure spuds or other barge equipment before navigating. The NTSB stated that the company’s crew should have been trained to identify potential safety hazards on vessels under their control.

NTSB Chairman Mark Rosenker said of the investigation’s results, “Having more rigorous requirements in place could have prevented this accident from occurring. Not only do these regulations need to be put in place but it is imperative that they are enforced and adhered to.”

The NTSB has made a number of safety recommendations as a result of this accident and the subsequent investigation. Recommendations were made to Athena Construction and Central Boat Rentals to develop procedures and train the employees of its barges to use the securing pins to hold spuds safely in place before transiting from one site to another.

The most major of the other recommendations are:

To the Occupational Safety and Health Administration:

  • Direct the Maritime Advisory Committee for Occupational Safety and Health to issue the following documents document to the maritime industry: (1) a fact sheet regarding the accident, and (2) a guidance document regarding the need to secure the gear on barges, including spud pins, before the barges are moved, and detailing any changes to your memorandum of understanding with the Coast Guard.

To the U. S. Coast Guard

  • Finalize and implement the new towing vessel inspection regulations and require the establishment of safety management systems appropriate for the characteristics, methods of operation, and nature of service of towing vessels.
  • Review and update your memorandum of understanding with the Occupational Safety and Health Administration to specifically address your respective oversight roles on vessels that are not subject to Coast Guard inspection.

The NTSB also released the result of its investigation into an environmental disaster in Kansas on October 27, 2004 in which 204,000 gallons (4,858 barrels) of anhydrous ammonia was spilled from a ruptured pipeline in Kingman into an environmentally sensitive area. Chemicals from the pipeline entered a nearby stream and killed more than 25,000 fish, including some fish from threatened species.

The incident reached the scale that it did due to operator error after the initial rupture. The 8 5/8-inch diameter steel pipeline, which was operated by Enterprise Products Operating L.P., burst at 11:15 a.m. in an agricultural area about 6 miles east of Kingman, Kansas. A drop in pipeline pressure, indicating abnormal conditions or a possible compromise in pipeline integrity, set off alarms displayed on the computerized pipeline monitoring system. Shortly after the first alarm the pipeline controller, in an attempt to remedy the low pressure, increased the flow of anhydrous ammonia into the affected section of pipeline. A total of 33 minutes elapsed between the time when the first alarm indicated a problem with the pipeline and the initiation of a shutdown.

In its initial report to the {{w|National Response Center|National Response Center|| (NRC), the pipeline operator’s accident reporting contractor reported a release of at least 20 gallons of ammonia, telling the NRC that an updated estimate of material released would be reported at a later time. No such report was ever made. Because of the inaccurate report, the arrival of representatives from the Environmental Protection Agency was delayed by a full day, affecting the oversight of the environmental damage mitigation efforts.

The cause of the rupture itself was determined to be a pipe gouge created by heavy equipment damage to the pipeline during construction in 1973 or subsequent excavation activity at an unknown time that initiated metal fatigue cracking and led to the eventual rupture of the pipeline.

“We are very fortunate that such highly toxic chemicals of the size and scope involved in this accident were not released in a populated area,” commented Rosenker. “Had this same quantity of ammonia been released near a town or city, the results could have been catastrophic.”

As a result of this accident, the NTSB made the following safety recommendations:

To the Pipeline and Hazardous Materials Safety Administration:

  • Require that a pipeline operator must have a procedure to calculate and provide a reasonable initial estimate of released product in the telephonic report to the National Response Center.
  • Require that a pipeline operator must provide an additional telephonic report to the National Response Center if significant new information becomes available during the emergency response.
  • Require an operator to revise its pipeline risk assessment plan whenever it has failed to consider one of more risk factors that can affect pipeline integrity.

To Enterprise Products Operating L.P.:

  • Provide initial and recurrent training for all controllers that includes simulator or noncomputerized simulations of abnormal operating conditions that indicate pipeline leaks.

“The severity of this release of dangerous chemicals into the community could have been prevented,” said Rosenker. “The safety recommendations that we have made, if acted upon, will reduce the likelihood of this type of accident happening again.”

As well as concluding their investigation of the above accidents, the NTSB also released preliminary information regarding a serious runway incursion at San Francisco International Airport between two commercial aircraft on May 26, 2007.

At about 1:30 p.m. the tower air traffic controller cleared SkyWest Airlines flight 5741, an Embraer 120 arriving from Modesto, California, to land on runway 28R. Forgetting about the arrival airplane, the same controller then cleared Republic Airlines flight 4912, an Embraer 170 departing for Los Angeles, to take off from runway 1L, which intersects runway 28R.

After the SkyWest airliner touched down, the Airport Movement Area Safety System (AMASS) alerted and the air traffic controller transmitted “Hold, Hold, Hold” to the SkyWest flight crew in an attempt to stop the aircraft short of runway 1L. The SkyWest crew applied maximum braking that resulted in the airplane stopping in the middle of runway 1L. As this was occurring, the captain of Republic Airlines flight 4912 took control of the aircraft from the first officer, realized the aircraft was traveling too fast to stop, and initiated an immediate takeoff. According to the crew of SkyWest 5741, the Republic Airlines aircraft overflew theirs by 30 to 50 feet. The Federal Aviation Administration has categorized the incident as an operational error.

The NTSB sent an investigator to San Francisco, who collected radar data, recorded air traffic control communications, and flight crew statements, and interviewed air traffic control personnel prior to the NTSB making the preliminary release.

New Zealand airlines relax knife regulations

New Zealand has relaxed the safety rules imposed on internal airlines in 2002, once more allowing passengers to carry pocket knives with blades less than 60mm long and knitting needles.

Other larger items remain banned, including ice-skates, pool cues, hockey sticks, skateboards, cricket bats and harpoons.

Other countries more at risk from terrorism such as the United States of America and Australia will maintain their stricter rules and continue to ban a range of small, sharp objects from their internal flights.

The airlines have also agreed to help return items seized from passengers before boarding.

Investigation into Mumbai train bombings begins

The toll in yesterday’s serial bombings on Mumbai‘s commuter trains has risen to 200 killed, with 714 people injured, according to the official estimate released by the Police. 127 victims have been identified and a further 56 remain unidentified, the estimate said. No group has so far claimed responsibility for the attacks. Indian authorities have said that the Kashmiri militant group Lashkar-e-Toiba (LeT) may be involved. An LeT spokesman has denied any involvement.

The day after the blast, schools, colleges and offices functioned normally in Mumbai and the commuter train service targeted in the bombings was operational. Many commuters rode the trains to work, though their numbers were smaller than usual. The Bombay Stock Exchange, located in the city shrugged off the bombings, with the BSE SENSEX gaining 3 percent on opening, calming fears that economic confidence will be undermined by the blasts.

Two San Diego art museums receive $40 million art collection

Two museums in San Diego, California have been bequested an art collection worth more than $40 million. The art collection was donated by Dr. Vance E. Kondon and Elisabeth Giesberger to both the Museum of Contemporary Art San Diego and the San Diego Museum of Art.

Kondon, a former board member of the Museum of Contemporary Art, died in 1997 and Giesberger died in 2011. Kondon was a notable art collector in San Diego, and collected for over 30 years. Roxana Velásquez, SDMA executive director, described their bequeathed collection’s “rarity” and said the pieces would add “depth” to the two existing museum collections.

The collection will be separated between the two museums due to the art movements represented within it. The Museum of Contemporary Art will receive 30 contemporary works by artists such as Franz Kline, Christo, and Craig Kauffman. The Museum of Art was bequeathed 48 German Expressionist paintings, drawings and prints. This collection includes artworks by Otto Dix, Gustav Klimt, and Egon Schiele.

If you are self employed, or are a director with more than a 5% shareholding in your company you can take up to 25% of your retirement fund in cash, tax free. Pension contributions are invested in funds, which grow tax free. This means that you are not liable for the 23% tax that other savings products incur.

The amount of money a company can pay into a pension plan on behalf of a director depends on your salary, the length of time you have been with the company and when you intend to retire. The amount of money which can be paid to a pension is very substantial and allows you to build up a large retirement fund, from which to pay off your mortgage. You can choose to retire any time between age 50 and 70.

The SAPS is probably the most flexible pension for company directors/ self employed. It does, however require a reasonably high level of contributions for it to be cost effective as set up costs tend to be 2,000 upwards and annual management fees around 1,000.

How a Pension Mortgage works.

On March 25th 2004 legislation changed to allow investors to combine the attractions of good quality property investment and related borrowings with the generous tax breaks afforded to pension plans.

A Pension Mortgage is one of the most tax efficient methods of repaying a home loan because customers utilize the cash value of a personal pension fund to repay the amount borrowed.

Some of the typical features of a pension mortgage are as follows;

  • The initial equity amount may be made up of a transfer value, single premium, or the first regular premium. Financial institutions will typically fund between 50% and 75% of the purchase price of the property.
  • All pension contributions can be offset against taxable income within Revenue approved funding limits.
  • Rents can be used to offset interest payments and as such are tax free.
  • A Pension mortgage is like an endowment mortgage, with only interest being paid on the loan.
  • You will probably be asked to take out a life policy to protect the lump sum in the event of death.
  • Investors have to remain at arms-length from any property invested in such a scheme, this means that they, or any person connected with them, may not utilize the property.

On exit from an investment, the property may be disposed of without capital gains and the capital can be put into an approved retirement fund.

This method provides tax relief not only on interest repayments but also on pension contributions (therefore, tax relief is also received on the capital repayments). In addition, the pension fund grows free of tax.

How you combine the two pension vehicles.

This means that a company director with more than 5% shareholding in their can use a pension mortgage to purchase a property in their own name, yet effectively have the company pay for it.

You take out a personal mortgage on which you make the interest payments. At the same time the company sets up your SAPS on your behalf which, at retirement, can be used to pay off the mortgage. The company receives full corporation tax relief on the pension contributions.

It is important that all aspects of the investment are looked at, including the potential for over-funding.

Strongest earthquake in 150 years hits Costa Rica

The United States Geological Survey said a 6.1 Mw earthquake struck on Thursday, at 01:21:34 p.m. local time (6:21:34 p.m. UTC) in northern Costa Rica, a Central American country, 30 kilometres (19 mi) NNW of San José and near the volcano Poás.

The epicenter was at 20 miles (32 kilometers) north-northwest of San Jose at a depth of 2.8 miles (4.5 kilometers), with Coordinate 10° 11? 49.2? N, 84° 9? 32.4? W, and Decimal 10.197,-84.159. Causing widespread panic and damage, it was felt all over Costa Rica as well as in southern central Nicaragua, and was the strongest to shake Costa Rica in about 150 years.

“Today is a day of mourning for Costa Ricans,” President Oscar Arias Sanchez said. “These losses of life fill us with pain; our prayers will be for their families, hundreds of families had seen serious damage to their homes,” Arias added. Originally seventeen people, including three children, were reported killed but was later decreased to 5 fatalities. About 42 were reported missing, at least 32 were injured and 2,450 people affected.

The quake toll jumped to 34 dead, 64 missing, on Saturday, while emergency workers rescued at least 200 stranded tourists in Varablanca hotel, according to Ministry of Infrastructure spokeswoman Silvia Chaves.

Amid problems of mudslides, cracked roads, tumbling rocks and fallen trees, National Social Security and Health agency, Red Cross rescue workers, firemen and police rushed Friday to evacuate about 600 people. Half of them were foreign tourists stranded in La Paz Waterfall Gardens eco-resort in Vara Blanca, and others were trapped by boulders and earth, when mountain roads in Costa Rica blocked two villages of Vara Blanca and Cinchona. The main CNE warehouse containing relief items (food, mattresses), for distribution to the victims, was burned, while the second airport in San Jose, is now closed.

Most of the victims died when part of the hillside collapsed and a landslide occurred near the La Paz waterfall at Vara Blanca, on the flanks of the volcano Poás. The Poas Volcano National Park was utterly destroyed and the La Paz waterfall road was torn, causing about 300 tourists trapped. At least 400 people were evacuated from the area in rescue helicopters.

Constant 2,000 aftershocks (1,200 through early Friday in the towns of San Pedro de Poas and Vara Blanca), complicated the rescue and emergency missions for stranded people in mountainous central zones. National Emergency Commission official Victor Falla said that there were small tremors every couple of minutes. “It’s shaking right now,” he added. 1,244 people were displaced, and 1,078 people are living in shelters. In addition, a hotel, houses, roads, and vehicles were damaged, and a couple of bridges were destroyed. The town of Cinchona was heavily hit, and all of the buildings there were heavily damaged. Power was temporarily disrupted in San José. “There are many buses and many vehicles that are trapped,” deputy public safety minister Jose Torres said.

In the central valley, populated by 2.5 million of the country’s four million inhabitants, the National Emergency Board declared an emergency in the metropolitan area including San Jose, Cartago, Alajuela and Heredia. The earthquake hit strongest the remote area near Alajuela. Several homes collapsed and major highways were still blocked.

A team of 34 U.S. military personnel and four Black Hawk helicopters from Honduras-based Joint Task Force-Bravo was sent on Friday by the U.S. Government to assist Costa Rican rescue workers, which include 400 volunteers and Red Cross personnel, who were dispensing aid in 15 communities. Colombia and China had also offered assistance to quake victims. The U.S. Army and Air Force aviation crews, rescue, medical and support personnel, is coordinating with the Office of U.S. Foreign Disaster Assistance (OFDA) in the rescue efforts. At least 150 stranded tourists from the United States, France, Canada and Spain, were finally rescued on Friday.

Hewlett-Packard to expand partnership with SAP

This Monday Hewlett-Packard is to announce that it is expanding its partnership with SAP. The partnership will be working with NetWeaver around several new services. The company is also expected to mention about its new enterprise solutions that are currently in development.

Hewlett-Packard will offer its clients services for upgrading servers, storage and NetWeaver – SAP’s application builder platform meant for integrating business processes throughout different systems. Among other services that the company is going to provide comprise assessment, governance and some architecture services for R3.

The manager of Worldwide Packaged Applications for Enterprise Applications Services at HP Services Consulting & Integration, Tim Treat, stated that the company first of all looks at servers, storage and management and only afterwards it makes a proposal regarding the things that are to be updated. He mentioned that when Hewlett-Packard will work on upgrading servers and management, it will turn its attention towards Intel.

After performing all the upgrades, the company is going to offer its clientele a variety of services package options that are related to NetWeaver. The services offered by Hewlett-Packard will include: enabling the service, design and implementation, application development and management.

Tim Treat said that adaptive infrastructure is one of the company’s new things that are to come. Recently the company’s clients have put in place enough hardware capacity and infrastructure with the goal of supporting peak or quarter-end processes. However, a big amount of that capacity is unused till peak times. This is why Hewlett-Packard looks forward to bring solutions that are to allow users pay for the things they really use.

Treat also outlined the fact that, besides its new services, the company is to announce business-process consulting together with IDS Scheer – software and consulting company, which is one of the leading providers of Business Process Management and IT solutions.

Explosives investigation at US Embassy in Chile; Pakistani man detained

A Pakistani man, identified as Muhammad Saif-ur-Rehman Khan, 28, was arrested in Chile on Monday after he was found with traces of explosives in the US Embassy.

Chilean police say that traces of Tetryl, used to help detonate explosives, were detected. Yesterday a judge ordered Khan’s continued detention under anti-terrorism laws.

It has been reported that Khan was in Chile for four months, and was called to the embassy to be told that his visa]] for the US was revoked. A US official told Reuters that “based on the information that we had, we revoked his visa.” The official declined to give the reason behind the decision, saying only that “[we] are required to notify individuals when we take that action and we invited him in.”

Khan spoke briefly to Chilean journalists and denied he was a terrorist or that he was handling explosives. “I’ve never seen anything like this in my life,” he said, claiming that the US “just want to hide the damage they have caused to Iraq and Afghanistan.”

This is not the first incident involving explosives at the US Embassy in Santiago; after the September 11 attacks of 2001, the embassy was sent a letter bomb that was defused.
